Effective on January 1, 2024
These Terms govern participation by Lobox users in the Lobox Job Referral Program. By submitting or accepting a referral, or participating in a paid referral opportunity, you agree to these Terms, the Lobox Terms of Service, Privacy Policy, and the job-specific referral terms displayed on the platform.
PROGRAM PURPOSE
Lobox may allow eligible users (“Referrers”) to refer individuals (“Referred Candidates”) to eligible jobs posted by third-party companies (“Companies”). Where a referral reward is displayed, the Referrer may become eligible to receive that reward only after all applicable conditions are satisfied and verified. Submitting a referral alone does not create a right to payment.
ELIGIBITY
You must have an active Lobox account, satisfy any profile-completion and age requirements, provide accurate information, remain in good standing, comply with applicable law and Lobox policies, and complete any identity, tax, sanctions, KYC or payment verification required for a payout. Lobox may restrict the Program by country, user, job, frequency, reward amount, or other reasonable criteria.
ELIGIBLE JOBS AND RECORDED TERMS
Not every job is eligible for a paid referral. The applicable job page may state the reward amount, currency, qualifying hiring event, payment milestone, qualification or retention period, expiration, and special conditions. Lobox may preserve a snapshot of those terms at referral submission, including the job, Company, Referrer, candidate, amount, currency, payout rules, timestamp, and terms version. Unless required otherwise by law, that snapshot governs the referral.
VALID REFERRAL AND CANDIDATE CONSENT
A referral must be submitted through Lobox’s official referral functionality. You should refer only persons you reasonably believe may be interested in the opportunity and must not provide false, misleading, unlawfully obtained, excessive, or unnecessary personal information. The candidate remains free to accept, reject, apply, interview, or withdraw. Lobox may require candidate confirmation or consent before further processing.
DESIGNATED REFERRER; JOB-SPECIFIC ATTRIBUTION AND DUPLICATE REFERRALS
Lobox may identify or display multiple users who may have a personal or professional connection to a potential candidate. Being displayed as a potential referrer, knowing the candidate, or being capable of making an introduction does not create any right to a Referral Reward.
For each referral opportunity, the Company, its authorized recruiter, or another authorized hiring representative may select one eligible Lobox user as the designated Referrer for the applicable candidate and position. Only the Referrer selected and recorded by Lobox for that candidate and position is eligible for the applicable Referral Reward. Other users who know, are connected to, or could refer the same candidate have no entitlement to that reward merely because of that relationship.
Once a referral has been initiated through Lobox, the designated Referrer generally may not be replaced for reward purposes. Lobox may correct or change the designation where reasonably necessary because of error, fraud, invalid eligibility, duplicate or conflicting referral information, candidate request, abuse, or another legitimate Program-administration reason. Lobox may use its platform records to determine the designated Referrer and referral attribution, subject to manifest error and applicable law.
PRE-EXISTING CANDIDATES
A referral may be ineligible if, before the referral was submitted, the candidate had already applied for the same position, had already been referred or submitted, was already actively under consideration, had been contacted by the Company or its authorized recruiter concerning that position, had been invited to interview, or had received an offer. Lobox may consider platform records and reasonable evidence from the Company or candidate.
SELF-REFERRAL AND PROHIBITED CIRCUMVENTION
Self-referrals are prohibited unless Lobox expressly permits them. You may not use alternate accounts, another person’s account, artificial reciprocal referrals, bots, bulk harvesting, timestamp manipulation, identity manipulation, or any arrangement intended to circumvent Program rules, referral limits, or eligibility requirements.
WHEN A REFERRAL REWARD IS EARNED
Unless the job-specific terms expressly provide a longer qualification period, a Referral Reward is earned only when all of the following have occurred: (a) the Referred Candidate was validly referred for the applicable position; (b) the Company hired or engaged that candidate for that position; (c) the candidate actually began the qualifying employment or engagement; (d) the candidate completed at least thirty (30) consecutive calendar days of active employment or engagement with the Company; and (e) all required Company, identity, tax, compliance, fraud-prevention, and payment verification has been completed. An offer that is declined, withdrawn, rescinded, or never results in an actual start does not qualify. If the candidate's employment or engagement ends for any reason before completion of the 30th consecutive calendar day, no Referral Reward is earned for that referral. A job-specific term may require a period longer than 30 days, but may not shorten the standard 30-day minimum unless Lobox expressly states otherwise in writing.
COMPANY PAYMENT; CONDITION PRECEDENT TO LOBOX PAYMENT
The Referred Candidate's completion of the applicable qualification period, including the standard minimum of thirty (30) consecutive calendar days of active employment or engagement, establishes only one condition of eligibility for a Referral Reward and does not, by itself, create an unconditional payment obligation of Lobox.
Unless Lobox expressly states in writing that a particular Referral Reward is guaranteed or funded directly by Lobox, Lobox's receipt of the corresponding referral fee from the Company in cleared, final, non-reversed, and non-disputed funds is an express condition precedent to Lobox's obligation to pay the Referral Reward to the Referrer.
Accordingly, Lobox has no obligation to pay the Referral Reward from its own funds if Lobox does not receive or retain the corresponding referral fee from the Company, regardless of the reason for non-payment or non-collection. This includes, without limitation, where the Company refuses, fails, or delays payment; disputes or denies a qualifying hire; conceals or fails to report the hire or engagement; provides inaccurate, incomplete, misleading, or fraudulent information; hires or engages the candidate outside Lobox in an attempt to avoid the fee; changes the job title, requisition, hiring entity, affiliate, employment classification, location, or engagement structure; closes, suspends, or abandons its Lobox account; reverses, cancels, charges back, or otherwise causes a payment to fail; becomes insolvent, bankrupt, ceases operations, or is unable to pay; or otherwise attempts to avoid or prevent payment.
Such conduct may constitute a breach of the Company's separate agreement with Lobox, and Lobox may pursue the Company for amounts owed. Lobox's right or decision to pursue, settle, compromise, or recover an amount from the Company does not require Lobox to advance, guarantee, finance, substitute for, or personally fund the Referral Reward.
A Referral Reward becomes payable by Lobox only after all applicable eligibility requirements are satisfied, Lobox completes any required verification, Lobox actually receives and retains the corresponding Company payment in cleared funds, and the Referrer completes all required identity, tax, compliance, and payment verification. If Lobox later recovers the applicable referral fee from the Company, Lobox may process the corresponding eligible Referral Reward under these Terms and its applicable payment procedures.
Lobox administers and facilitates the Referral Program and, except where Lobox expressly agrees otherwise in writing, is not the guarantor of a Company's referral-fee obligations.
HIRING OUTSIDE LOBOX; ANTI-CIRCUMVENTION
A qualifying referral does not become invalid merely because the Company later communicates with, interviews, offers to, hires, or engages the candidate outside Lobox. Where the Company’s applicable terms treat the transaction as a qualifying hire, Lobox may continue to recognize the referral. A change in job title, hiring channel, requisition number, work location, employment classification, account status, removal of the posting, or substantially equivalent hiring arrangement does not automatically defeat a valid referral. Unless job-specific terms state a different attribution period, a valid referral may remain attributable to the applicable position for twelve (12) months from the referral submission date for purposes of determining whether a qualifying hire occurred. Eligibility remains subject to the recorded terms and applicable law.
AFFILIATES, CONTRACTORS AND DIFFERENT ENGAGEMENT FORMS
Where the applicable Company terms and job-specific referral terms provide for it, a qualifying hire may include employment or engagement through the Company’s parent, subsidiary, affiliate, controlled entity, staffing arrangement, consulting arrangement, independent-contractor relationship, or substantially similar working relationship. This provision does not expand a reward beyond the scope of the terms recorded for the referral.
MILESTONES, CANDIDATES DEPARTURE AND REVERSALS
The standard minimum qualification period is thirty (30) consecutive calendar days of active employment or engagement after the candidate's actual start date. A job may state a longer period or additional milestones, such as 60, 90, or 180 days. If the candidate resigns, is terminated, abandons the position, fails to start, or otherwise ceases the qualifying employment or engagement before completing the applicable minimum period, the Referral Reward is not earned. If additional milestones apply, any portion dependent on an uncompleted milestone is not earned. Lobox may withhold, delay, reverse, offset, or recover a reward or payment where there is fraud, abuse, duplicate payment, chargeback, Company payment reversal, payment-provider reversal, sanctions/compliance concern, material misrepresentation, manifest error, invalid referral, or other circumstance permitted by applicable terms or law.
PAYMENT PROCESSING, TAXES AND VERIFICATION
Lobox or its payment provider may require your legal name, identity, residence, address, tax information, age, payment details, and other compliance information. Rewards may be taxable income, and you are responsible for your tax obligations except where withholding or reporting is required by law. Payment methods, processing times, minimum payout thresholds, supported currencies, conversion rates, and fees may vary by country or provider.
NO EMPLOYMENT, AGENCY OR AUTHORITY
Participation does not make you an employee, worker, agent, recruiter, broker, partner, joint venturer, or representative of Lobox or the Company. You have no authority to bind Lobox or a Company, make employment promises, negotiate on their behalf, guarantee hiring outcomes, or represent that you are authorized to act for them. Any classification required by mandatory law will apply notwithstanding this clause.
HIRING INTEGRITY, NON-DISCRIMINATION AND COMMUNICATIONS
You must not bribe or improperly influence hiring personnel, manipulate evaluations, provide false references, conceal material information, misrepresent a job, spam candidates, or make deceptive statements. Referrals must not be used for unlawful discrimination. You must comply with applicable privacy, anti-spam, employment, and communications laws when contacting potential candidates.
FRAUD, ABUSE AND ENFORCEMENT
Lobox may investigate suspected fraud, collusion, fake candidates, fabricated employment, duplicate or synthetic accounts, referral farms, automated abuse, false Company confirmations, unauthorized personal-data use, payment fraud, or manipulation of hiring records. Lobox may place rewards on hold, request evidence, reject referrals, cancel pending rewards, restrict Program access, suspend or terminate accounts, and recover improper payments where legally permitted.
VERIFICATION, PLATFORM RECORDS AND DISPUTES
Lobox may request reasonable evidence from the Company, Referrer, or candidate to verify the qualifying hire or engagement, actual start date, position, thirty (30) consecutive days of active employment or engagement, any longer qualification period, compensation or engagement type where relevant, and other reward conditions. Lobox may delay payment while a good-faith verification, fraud, compliance, payment, or attribution review remains unresolved. Absent manifest error, Lobox platform records concerning referral submission time, job association, displayed terms, acceptance, status, and system events may be treated as presumptively accurate for Program administration. You should dispute an attribution, rejection, reversal, or payment calculation within 30 days after the relevant notice or payment, unless applicable law requires a different period.
PRIVACY AND CANDIDATE INFORMATION
Referral-related personal information is processed under the Lobox Privacy Policy and applicable law. You must not upload sensitive or unnecessary information about another person. Candidate information may be used for legitimate recruiting, referral, verification, fraud-prevention, compliance, security, and payment purposes as permitted by applicable terms and law. Lobox may limit information disclosed to a Referrer to protect candidate and Company privacy.
PROGRAM CHANGES, SUSPENSION AND TERMINATION
Lobox may prospectively modify, suspend, restrict, or terminate the Program or participation in it for business, regulatory, security, fraud-prevention, operational, or technical reasons. Changes should not ordinarily reduce a reward already earned under a completed qualifying event. A referral submitted before a change remains subject to its recorded terms except where law, fraud prevention, security, or an expressly applicable provision requires otherwise.
NO GUARANTEE; LIMITATION OF PROGRAM EXPECTATIONS
A referral does not guarantee candidate review, interview, offer, employment, salary, continued employment, or a reward. Hiring decisions belong to the Company. Lobox does not guarantee that a Company will pay amounts when due, that a candidate will remain employed, or that every jurisdiction will permit participation. Nothing in these Terms excludes rights or liabilities that cannot lawfully be excluded.
RELATIONSHIP TO OTHER LOBOX TERMS
These Terms supplement the Lobox Terms of Service, Privacy Policy, and job-specific referral terms. Job-specific terms control the reward mechanics for that referral where they expressly differ from these general Terms. If another Lobox agreement contains mandatory provisions that apply to your account or jurisdiction, those provisions also apply. Lobox may require affirmative acceptance of the applicable terms and retain the accepted version and timestamp.
CONTACT AND LEGAL REVIEW NOTICE
Questions or disputes concerning the Program should be submitted through the support or dispute channel designated by Lobox. These Terms are intended as the operational user-side rules of the Program and should be reviewed by qualified legal and tax counsel before production launch in each jurisdiction where paid referrals are offered.
